Terms of Use

1. Acceptance of Terms

By accessing or using Vibeland ("the Service") at vibeland.app, you agree to be bound by these Terms of Use. If you do not agree, do not use the Service.

2. Description of Service

Vibeland is an AI-powered platform that transforms natural language prompts into interactive applications. The Service includes:

• AI Canvas — workspace for generating and managing apps
• Agent Marketplace — create, publish, and hire AI agents
• App Store — discover and install community-created apps
• Spark Economy — virtual currency for platform transactions
• Design Systems — customizable visual themes for generated apps
• Groups — collaborative workspaces for teams

3. Account Registration

• You must be at least 13 years old to create an account.
• You are responsible for maintaining the security of your account credentials.
• You must provide accurate and complete information during registration.
• One person may not maintain more than one account.
• You are responsible for all activity that occurs under your account.

4. Subscription Plans & Sparks

4.1 Plans

Vibeland offers a Free tier and a Pro subscription ($9.99/month). Pro subscriptions are billed monthly through Stripe and can be cancelled at any time. Cancellation takes effect at the end of the current billing period.

4.2 Sparks (Virtual Currency)

• Sparks are a non-transferable virtual currency used within the platform.
• Sparks can be earned through creator sales or purchased via Stripe.
• Sparks have no cash value and cannot be exchanged for real currency.
• We reserve the right to adjust Spark pricing and generation costs.
• Unused purchased Sparks do not expire; free Sparks are subject to balance caps.

4.3 Usage Limits

Each tier has usage limits including generation windows, daily caps, and balance caps. When limits are reached, the Service may switch to lighter AI models (graceful degradation) rather than blocking access entirely.

4.4 Refunds

Spark purchases and subscription payments are generally non-refundable. If you believe a charge was made in error, contact us at codefulteam@gmail.com.

5. User Content & Ownership

5.1 Your Content

You retain ownership of the prompts you submit and the content you create on Vibeland. AI-generated apps and source code produced through the Service are owned by you, subject to any applicable third-party licenses of libraries used in the generated code.

5.2 License to Vibeland

By publishing content to the App Store, Agent Marketplace, or Design System library, you grant Vibeland a non-exclusive, worldwide license to display, distribute, and promote your content within the platform. This license ends when you unpublish or delete the content.

5.3 Creator Marketplace

• Creators earn Sparks from marketplace sales (Free: 70%, Pro: 85% revenue share).
• A burn fee (Free: 30%, Pro: 15%) is deducted from each sale.
• You may not purchase your own published content.
• We reserve the right to remove content that violates these terms.

6. Acceptable Use

You agree NOT to use the Service to:

• Generate content that is illegal, harmful, threatening, abusive, or discriminatory
• Create malware, phishing tools, or apps designed to exploit or harm users
• Attempt to extract, reverse-engineer, or abuse AI model capabilities
• Circumvent usage limits, rate limits, or security measures
• Impersonate other users or misrepresent your identity
• Distribute spam, unwanted promotions, or misleading content
• Scrape, crawl, or automate access to the Service without permission
• Interfere with the operation of the Service or its infrastructure
• Violate intellectual property rights of others

7. AI-Generated Content

• AI-generated apps are created by third-party AI models (OpenAI, Google, Anthropic) based on your prompts.
• We do not guarantee the accuracy, quality, safety, or fitness of AI-generated content.
• Generated apps may contain bugs, inaccuracies, or unintended behavior.
• You are responsible for reviewing and testing generated apps before publishing or distributing them.
• Generated code runs in a sandboxed environment but may make network requests to external APIs.

8. Intellectual Property

The Vibeland platform, including its design, code, branding, and documentation, is owned by Vibeland and protected by intellectual property laws. You may not copy, modify, or distribute the platform itself. This does not restrict your rights to content you create using the platform.

9. Termination

• You may delete your account at any time. Deletion permanently removes all your data.
• We may suspend or terminate your account for violations of these terms.
• We may discontinue or modify the Service at any time with reasonable notice.
• Upon termination, your right to access the Service immediately ceases.
• Provisions regarding ownership, liability, and disputes survive termination.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIBELAND SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Vibeland and its team from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these Terms.

13. Governing Law

These Terms are governed by the laws of the United States. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction.

14. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes by posting the updated Terms and revising the "Last updated" date. Continued use after changes constitutes acceptance.
